DMCA / Copyright Policy

Curbside.bio respects the intellectual property rights of others and expects users of the platform to do the same. We comply with the Digital Millennium Copyright Act ("DMCA") and will respond to properly submitted notices of alleged copyright infringement.

Submitting a DMCA Notice

If you believe that content available on Curbside.bio infringes your copyright, you may submit a written notification to our Designated Agent. Your notice must include the following:

  1. Your physical or electronic signature
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material that is claimed to be infringing, including information reasonably sufficient to permit us to locate the material (such as a URL)
  4. Your contact information, including your name, email address, and, if available, telephone number
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

What Happens Next

Upon receipt of a valid DMCA notice, we will:

  • Review the notice for completeness and validity
  • Remove or disable access to the allegedly infringing material, where appropriate
  • Notify the user who posted the content, if applicable

We may take additional action, including removing content or restricting accounts, where appropriate.

Counter-Notice Procedure

If you believe that your content was removed or disabled in error or misidentification, you may submit a counter-notice in accordance with the DMCA.

A valid counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed or disabled and the location where it appeared before removal
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and contact information
  5. A statement that you consent to the jurisdiction of the federal court in your district (or where applicable), and that you will accept service of process from the person who submitted the original DMCA notice

Counter-notices should be sent to the same Designated Agent listed above.

Repeat Infringer Policy

Curbside.bio may, in appropriate circumstances and at its discretion, suspend or terminate the accounts of users who are determined to be repeat infringers of intellectual property rights.
