Curbside Tech Inc. (“Curbside” or the “Company”) is committed not only to providing exceptional service to consumers, but also to protecting consumers’ privacy and complying with applicable data protection and privacy laws.  “Curbside” refers to Curbside Tech Inc. including all its officers, directors, employees, agents, successors, assigns, predecessors, group of companies, affiliates (also referred to collectively as “we”, “us”, or “our”).  A “Consumer” or “User” is a person who purchases our products or services, uses or registers into our services, enters into a sales promotion or a campaign, visits our Website, or otherwise, interacts with us.  “Website” shall include but is not limited to curbside.bio and other domain names operated by the Company’s affiliates, partners, predecessors, and successors.

These Privacy Policy Guidelines (“Guidelines”) are designed to help Consumers understand what kind of information we collect from them (as defined below) in connection with Curbside products and services, and how we use such information.  Consumers acknowledge and agree that their Personal Data that is collected and may be used in accordance with these Guidelines by and for one or more Curbside companies, which will be regarded, individually or jointly, as data controllers in respect of such data.  Throughout these Guidelines the term “Personal Data” means information relating to an identified or identifiable individual (i.e. a natural person).

We typically provide additional privacy related terms in connection with particular Curbside products or services.  Such product or service specific terms prevail over the Privacy Policy to the extent of any conflict.  Our products or services may also contain links to other companies’ websites and other third-party services that have privacy policies of their own.  Curbside is not responsible for the privacy practices or contents of any such third-party services.

Where a consent from a Consumer to the processing of Personal Data described in the Privacy Policy is required under the applicable law, such consent will be obtained by appropriate mechanism such as ticking a box stating Consumer consent, choosing technical settings for a service or website, or other statement or conduct clearly indicating the Consumer’s acceptance to the processing, depending on the product, website, service or application the Consumer is using.

What Personal Data is Collected?

At Curbside, we strive to collect only the Personal Data we need. We collect Personal Data typically when a Consumer purchases our products or services, uses, registers, or logs into our services, enters into a sales promotion or a campaign, visits our Website, or otherwise interacts with us. Below are examples of the categories of the data we collect from Consumers.

Technical Information

For the most part, Consumers may visit our Websites or use our products or services without having to identify themselves.  However, certain technical information is normally collected as a standard part of the Consumer’s use of our services.  Such information includes (but is not limited to), for example, the Consumer’s IP-address, access times, the Website Consumer linked from, pages Consumer visited, the links the Consumer use, the ad banners and other content Consumers viewed, information about Consumer devices and other such technical information that the Consumer’s browser provides us with or as may be otherwise collected in connection with certain products and services.  When the Consumer uses our services or otherwise interact with us over telecommunications networks, certain additional information, such as Consumer’s mobile subscription number, may be transmitted to us by the telecommunications operator as a standard part of that communication.

Information Consumer Provides Us

When you engage in certain activities on our Website, such as rating and reviewing treatments for a particular disease or illness, searching for a disease in our database, adding or editing disease pages, creating and maintaining a user account on our Website (“Account”), filling out a survey, or sending us feedback (individually, each an “Activity”; and collectively “Activities”), we may ask you to provide certain information. If you choose to share any personal information with us, the amount and type of personal information we request depends on how you participate in an Activity or use the Website.

For example, once you register on our Website, or rate and review treatments, we will collect your name and contact information, including your e-mail address when such information is provided. In addition, Curbside will collect any communication you engage in with us (e.g. comments, e-mails, chat transcripts, and questions you direct to our attention).

It is completely optional for you to engage in these Activities. However, if you elect to engage in these Activities, depending upon the Activity you engage in with Curbside, some of the information we ask you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory data with respect to a particular Activity, you will not be able to engage in that Activity.

Any information you submit in reviews, comments, or other public areas of the Website is voluntarily provided by you, will be publicly visible, may be shared or indexed by search engines, and is not subject to HIPAA protections.

Device Information

Internet Protocol (IP) Address (“IP Address”): An IP address is a number that is automatically assigned to your computer every time you browse the Internet. When Users request a page from our Website, our servers log the User’s current IP address. We use IP addresses to help diagnose problems. We do not link IP addresses to any personal information about you.

In addition to your IP address, Curbside may collect device-specific information such as operating system version, device hardware model, other unique device identification information, and mobile device information such as your telephone number. Curbside may associate these pieces of device information with your Curbside Account.

Analytics Information

Our Website uses “Cookie” technology.  “Cookies” are encrypted strings of text that a website stores on a User’s computer.  Cookies are used to recognize return visitors, allow registered Users to login without typing their login name each time, store and recall User preferences and identify which of our web pages are most useful for our visitors, measure usage of our Website and the various pages on the Website, and provide functionality and content that we believe would be of interest and value to you. We utilize various technologies to collect and store information when you visit Curbside, including but not limited to: sending cookies, anonymous identifiers, pixels, or web beacons to your device.  These identifiers may also be used when you interact with the Activities we offer to our partners (such as advertising services or Curbside features that may appear on other various websites).

We do not use cookies to gather information concerning your visits to other websites, nor ascertain any personal information about you apart from your dealings with the Website, and your transaction history with Curbside.  Cookies do not corrupt or damage your computer or computer files.

If you do not wish to receive these cookies, you may set your browser to reject the cookies (consult the instructions for your particular browser on how to do this), although doing so may affect your ability to perform certain transactions on our Website.

Device Identifiers

Anytime you use a mobile device such as a cellular phone or tablet to access Curbside’s Website, we may collect, monitor, access, store on your device, and/or store one or more “device identifiers” remotely.  A “device identifier” is a small data file or similar data structure which is associated with or stored on your mobile device.  These device identifiers uniquely identify your mobile device and may be stored in connection with device hardware, operating system, or other software.

Your browser automatically reports log file information each and any time you request to visit a web page or app, or you download a webpage or app to your browser or device.

Curbside automatically records certain log file information, including: your web request, IP Address, browser type, exit pages, URLs, number of clicks, your interaction with links on our Websites, domain names, landing pages, pages viewed, etc.

The purpose of collection of such information is to improve Curbside and its Website’s services and Activities, for its Users, clients, and customers.

Data Concerning Minors

Curbside does not seek to collect any information from or engage in any transactions with persons under the legal age in their respective country. Our databases may nevertheless contain Personal Data of children since it is not always possible to determine precisely the age of the User. If we learn that a minor has provided Curbside with personal information, we will use reasonable efforts to remove such information from our files. We reserve the right to block the service from any person who is or whom we reasonably suspect of being a minor. Curbside policy is to request that minors do not make purchases, use our Website, or engage in other legal acts on our products and services without the consent of a parent or legal guardian, unless otherwise permitted by applicable law. If the Consumer is a minor but has the Consumer’s legal guardian’s consent, the Consumer must be able to prove that such consent exists upon request.

We encourage parents and guardians to observe, participate in, and/or monitor and guide their children’s online activity. Curbside does not knowingly collect any personal identifiable information from children under the age of 13. If you think your child provided this kind of information on our website, we strongly encourage you to contact us immediately and we will do our best to promptly remove such information from our records.

Data Retention

We store Consumer Personal Data only for a period necessary for the purpose in question or as long as required by applicable laws.

Use of Personal Data

The purpose of our use of your information is so we can provide you and other Curbside Users with the best Curbside and website experience possible. Your information is collected and used to provide you with: more tailored content; more relevant search results and advertisements; more efficient access to your information after you sign into the Website; assistance with remembering information so you need not re-enter it during your next visit to the Website; monitoring of the effectiveness of Curbside and the Website’s services; development and testing of new features, as well as diagnosing and fixing various technological issues; automatic updates to the Website and the Curbside app on your device, etc.

Additionally, we may use your personal information for particular purposes such as marketing research and other marketing purposes and for providing you with the latest promotional information and other information that might be useful to you. We may use your personal information to deliver information to you and to contact you regarding administrative notices. We may share this information with Curbside Affiliates (defined below) or other business partners to support your customer relationship with Curbside.

Curbside may combine Personal Data collected with Consumer use of a particular Curbside product and/or service with other Personal Data.

Curbside may use Personal Data to communicate with Consumers, to provide information relating to our products and/or services Consumers are using or to contact Consumers for customer satisfaction queries. We may use Consumer Personal Data for marketing purposes including using Personal Data for personalized marketing or research purposes in accordance with applicable laws.

Curbside may use Personal Data for profiling/personalization for such purposes as targeted direct marketing and improvement of our products or services. We may also create aggregate and store statistical information based on Consumer Personal Data.

California Consumer Privacy Act (CCPA) Privacy Rights
Under the CCPA, among other rights, California Consumers have the right to:
  • Request that a business that collects a consumer’s personal data disclose the categories and specific pieces of personal data that a business has collected about consumers.
  • Request that a business delete any personal data about the consumer that a business has collected.
  • Request that a business that sells a consumer’s personal data, not sell the consumer’s personal data.
  • If you make a request, we have one month to respond to you. If you would like to exercise any of these rights, please contact us.
Nevada Consumer Privacy Rights

Nevada Consumers have the right to opt-out of having their personal information sold to third-parties. Curbside does not sell personal information, but Consumers may contact Curbside if they have any questions or concerns about the use of personal information. If you make a request, we have 60 days to respond to you. If you would like to exercise any of these rights, please contact us.

General Data Protection Regulation (GDPR) Data Protection Rights
If you are in the European Economic Area (EEA), the United Kingdom, or Switzerland, Curbside Tech Inc. is the controller of your personal data. We process personal data on the following legal bases:
  1. performance of a contract;
  2. legitimate interests such as improving services and security;
  3. compliance with legal obligations; and
  4. consent, where applicable.

International Transfers: We may transfer data to the United States and other countries that may not provide the same level of protection as your jurisdiction. Where required, we use safeguards such as Standard Contractual Clauses (SCCs).

Your Rights (EEA/UK): You may have rights to access, rectify, erase, restrict, or object to processing, to data portability, and to withdraw consent without affecting the lawfulness of processing before withdrawal. You may also lodge a complaint with your Supervisory Authority.

Changes to this Privacy Policy

Curbside’s Privacy Policy may change from time to time. As a result, please check back periodically and review the Policy.

Curbside may provide you additional forms of notice of changes made to this Privacy Policy as appropriate under the circumstances. However, we will not reduce your rights under this Privacy Policy without your explicit consent.

Your continued use of and participation in the Activities or the Website after any modification to this Privacy Policy will constitute your acceptance of such modification.
