Welcome to curbside.bio (the "Website"). Please read the following Terms of Use (the "Agreement" or "Terms of Use") carefully before accepting. This is a legal contract between Curbside Tech Inc. ( "Curbside" or the "Company") and the entity or individual using any database, software, mobile applications, content, data, materials, documentation, information, services, or websites created, published, or owned by Curbside, its affiliates, or its licensors ("Licensed Content"). "You" or "Your" means any user of the Licensed Content. By accessing or using the Licensed Content, you accept all of the terms and conditions of this Agreement and agree to be bound by this Agreement. If you do not accept the terms of this Agreement, you are not permitted to use the Licensed Content.

Curbside is not a healthcare provider, and the Licensed Content is not intended to provide medical advice, diagnosis, or treatment or substitute for individual patient assessment by a qualified healthcare provider. The information and materials on this Website do not represent the position or opinions of Curbside or its partners or advisors collectively, and they do not constitute professional advice. User Content License

By submitting reviews, comments, ratings, posts, or other content ("User Content") to Curbside.bio, you grant Curbside Tech Inc. a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, modify, publish, distribute, display, and create derivative works from such User Content in connection with operating, improving, promoting, and researching the Curbside.bio platform and related services.

Disclaimer of Warranties

The Licensed Content is provided "AS IS" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Curbside makes no representations or warranties about the accuracy, reliability, completeness, or timeliness of the Licensed Content.

Limitation of Liability

In no event shall Curbside or its partners, subsidiary entities, affiliates, and contributors to this Website be liable for any loss or injury, or any damages, whether direct, indirect, incidental, consequential, exemplary, punitive, special or otherwise, including but not limited to loss of profits, data, or goodwill, whether based on breach of contract, tort (including negligence), product liability arising out of or in connection with the use or inability to use the Licensed Content. You hereby waive any and all such claims against Curbside, its partners, affiliates, and contributors. To the fullest extent permitted by applicable law, Curbside's total liability arising out of or relating to the use of the Website shall not exceed one hundred U.S. dollars ($100).

Indemnification

You agree that you will not use this Website for any unlawful purpose, or for any purpose prohibited by this Agreement. You agree to indemnify, defend and hold harmless Curbside, its partners, affiliates, and contributors from any liability, loss, claim and expense (including attorneys' reasonable fees) related to (i) your violation of this Agreement, and/or (ii) your posting or use of materials on this Website.

Non-waiver

Curbside's failure to adhere to strict enforcement of any provision of this agreement shall not be construed as a waiver of any provision or right.

User Responsibility

Users agree to use the Licensed Content responsibly and comply with all applicable laws.  Users agree not to harass, threaten, abuse, or harm others; post knowingly false or defamatory statements about treatments, providers, or healthcare services; share personal data of others without consent; upload malicious code or disrupt the Website's operation; post spam, promotions, or commercial solicitations without prior authorization; infringe the intellectual property or other rights of any person or entity; or fail to disclose any material connections or conflicts of interest when posting about products or treatments. Curbside reserves the right to terminate or suspend user access in cases of violation.

When discussing healthcare providers, treatments, or medical conditions, users should describe their personal experiences or opinions and avoid presenting personal opinions as medical facts. Curbside.bio does not independently verify the accuracy of user-submitted medical information.

Content Disputes

Healthcare professionals or organizations who believe a review or comment contains inaccurate or defamatory information may contact Curbside.bio for review. Curbside reserves the right, but not the obligation, to evaluate and determine whether such content violates our policies. Submission of a dispute does not guarantee removal of the content.

User-Generated Content and Accuracy

Curbside.bio hosts content submitted by users. Reviews, comments, ratings, and opinions posted on the Website reflect the views of the individual authors and do not represent the views of Curbside.
